Official Update - Every episode in this season has now been plotted out and named. Expect some huge callbacks to the first season, lines AND characters. Expect the CRAZIEST storylines this side of the norm-land. Expect a truly amazing season, that really pays homage to The O.C...all I can say, expect the best, guys and gals! Very Happy

THANK GOD. We thought we (and by 'we', I mean my partner) thought we accidentally deleted the thread. Somehow. I don't know how we did it. Anyway, guess whats tonights. It's happening. Its the Return of the OC (well, ours), and its returning tonight!

OK. I originally posted the episode, screwed up, had to delete it, we thought the thread was deleted, I yelled at my co-writer, he yelled calmly back, he started writing his episode finally, and then our thread came back...

....uh. Our return episode is going to be posted later tonight.

Ryan: Previously on the OC

*Sandy walks into the Cohen house*

Sandy: They’re going to put me on trial for Carter’s murder.

*Sandy pushes Carter against the wall, it kills him*

Seth: What happened?

Summer: Well, we confronted Julie about her problem, and she went insane, and she was having sex with Luke and she hit Kaitlin with a lamp

Seth: Typical.

Summer: Our problem is, since we know we're going to be together forever, we are subconsciously afraid of the fact that we're never going to have sex with anyone else. So, I have an idea, we both have sex with ONE other person, by the new year,"

Seth: I completely agree.

*Seth walks into a room to see Anna and Taylor, he smiles gleefully. This’ll be easy*

Detective Rane: I know for a fact Trey Atwood killed Volchek.

--

*The cops chase Trey and Ryan*

Trey reached over to his brother and ruffled his hair. "Get out of Chino while you still can Ry."

"Trey...no..." Ryan whispered through gritted teeth.

Trey pulled out a gun, and opened the door.

"Trey!" Ryan yelled again. "Don't!"

Trey looked at his brother once more slowly, and then steps out of the car. He slowly raises the gun as four bullets plug his chest.

Trey falls to the ground as his brother's mouth drops. Ryan can only mouth "I love you" as he gasps for air

The Trial

A young, 11 year old Ryan Atwood plays with his older brother, Trey, in their small house. Dawn is screaming at one of her boyfriends, Ryan begins to cry. Trey walks him outside, soothing him.

"Are you always gonna be there for me Trey?" Ryan cries.

"Yeah."

Ryan sits at the end of a table in a dark room as Detective Rane sits across from him.

Ryan has a terribly grim look on his face as he is avoiding Rane's eyes.

"He had a gun, Ryan."

"He wasn't going to fire." Ryan replied.

"He was taking aim. I wasn't about to let my men get shot," Rane replied.

"So killing my brother was a scapegoat to save your men. You don't even know them! Trey was my BROTHER!" Ryan slammed his fist down on the table, for the third time in one night.

Rane looked at Ryan, and they both stared in silence until Ryan spoke.

"And I understand that it was your job to protect your men, but shoot his hand. Shoot him with a rubber bullet. Do SOMETHING other then fill his chest with bullets," Ryan explained calmly, yet angrily at the same time.

"I know Ryan, and you can bet your ass I'm talking to whoever it was that fired those shots -- it wasn't procedure."

"I'll feel a lot better knowing the guy who shot my brother will get a talking to, Detective, thank you," Ryan replied coldly.

Rane finally stood and approached the door. He opened it, and before walking out said, "Ryan...I'm sorry about your brother."

A black stretch limo drove down a road with Sandy and Jimmy sitting in the back. A squad car in the front and back escorted the car.

Sandy had his head stuck out of the window, looking at the squad car.

"What the hell are you doing?" Jimmy asked.

Sandy pulled himself back in. "Making sure it was a real license plate."

Jimmy laughed as Sandy's cell phone rang.

"Yeah?" Sandy asked.

After a few moments, he said, "Where are you?"

Again a small pause before, "They shot Trey?"

Sandy flipped his phone shut and slid down the privacy window. "We're going to Chino."

As the clock struck 2 AM, Kaitlin lay back in her [AKA Seth's] bed and screamed one last time. "Oh god Luke..." She moaned.

"I try," Luke grinned to himself, lying back.

"We definitely...must do that..again...and maybe again," Kaitlin whispered, lying on her side.

Luke lay on his side as well, as they stared into each other's eyes. Luke brushed a strand of her hair behind her ear.

"I'm really sorry about...well, you know," Luke admitted.

Kaitlin sighed, shaking her head. "It's fine, she's the whore Luke...I hope she rots in there."

Luke's eyes wandered as he said, "Don't you think that's a little harsh?"

Kaitlin's eyes narrowed. "Not one bit."

"I mean, it's just she's your mother and all, you know?"

"I don't care if she's Mother Theresa herself, she has done everything a true backstabbing, whoreish bitch would do...so for that, I am done with that woman," Kaitlin replied coldly.

Luke stared at Kaitlin for a moment. "I'm sorry for bring that up...it must be so hard."

"Don't be," Kaitlin replied. Kaitlin shifted on top of Luke, kissing him as she moved all over Luke. "It's not your fault." They began kissing passionately.

Ryan stepped out of the Chino Police Station with Seth as Detective Rane follows behind.

"You're not in any trouble, but I'm going to need you to come back in
a few days for a statement," Rane said.

"On what? Your wonderful department? Or my even better family?" Ryan replied, barely audible.

Rane sighed. "Just come back in three days, Ryan, please."

Ryan said nothing as he walked down the sidewalk, Seth walking beside him.

"I'm so sorry man," Seth said quietly.

Ryan just slightly nodded.

Ryan heard and saw someone named Pierce ahead, talking on a cell phone with his back turned.

Ryan suddenly stopped.

"Ryan...?" Seth asked.

"Shut up," Ryan whispered.

Seth followed his directions as he watched Ryan slowly stalk up behind Pierce.

Ryan wrapped his arm around Pierce and walked him behind the corner of a building, as his phone dropped.

"Ryan!? What the hell!?" Pierce yelled.

"Oh god..." Seth whispered. He slowly jogged to the building.

"If your punk ass wouldn't have called the cops..." Ryan accused through gritted teeth as he held Pierce against the wall, his elbow in
Pierce's throat.

"Ease up Ry! I didn't do nothing!" Pierce yelled.

"Don't call me Ry ever again you no-moralled son of a bitch!" Ryan yelled, throwing a punch as it connected with Pierce's cheek.

Pierce fell to the ground, trying to shield his face. "Please! I'm sorry, OK!? I'm sorry!"

Ryan dropped onto Pierce and continued punching him. Pierce's faces quickly turns into Volchok's. As soon as this happens, Ryan holds back a mid-punch.

"Ryan!" Seth yelled.

Ryan breathed slowly and glared at Pierce. "If I ever see you again, I won't stop next time. Do you understand me?"

Pierce nodded in fear.

Ryan stood up angrily and walked off with Seth.

Once they were out of earshot, Pierce picked up his phone. "Was that him?"

"Yeah."

The other person ended the call.

Detective Rane puts his phone down, sighing. There's only so much he can do.

---

Ryan and Seth sat next to each other a public bus. "Are you sure you want to head back to Newport so soon?"

Ryan nodded distantly. "My brother was falsely accused of a murder I committed, so it's not like I have to hide; and it's also not like I need to say goodbye to family," He explained softly.

Seth only nodded to himself awkwardly. "OK then...probably should call my dad about now," He pulled out his phone.

"Yeah dad, uh, forget the whole Chino deal. Ryan and I are coming back."

"And I know you're not coming back home without an explanation, so I won't worry," Sandy replied, nodding from his limo.

"Oh yes. An explanation for the ages, dad." Seth quickly shut his phone and turned to Ryan.

"Dude we're so screwed," Seth sighed.

The sun began to rise over the large Cohen Palace and shine through the windows as Kaitlin was standing, putting her braw back on from last night.

She felt warm hands touch her hips. She turned around to see Luke. He began to massage her slowly. He kissed her shoulder.

"Luke it's morning," She said, grinning.

"You're right Kaitlin, it's morning." The two shuffle back into the same place they were the night before.

Julie held the phone to her ear in her musty orange prison cloths. "Kirsten, I can't spend another night here. I WON'T spend another night here."

"I talked to the police, and they said your hearing would be in two weeks, so until then..." Kirsten's voice trailed off.

"Kirsten! I am in prison!"

Kirsten finally snapped at this. "Yes Julie, you ARE in prison. For hitting your own daughter in the head with a lamp. And yet you still expect me to feel sorry for you!?" Kirsten basically yelled into the phone. "What you did was horrible!"

"Well maybe if someone's son didn't cause the death of my other daughter I wouldn't of had to resort to what I'm doing! Did you even think of the withdrawals I'll be experiencing in here!?" Julie snapped back immediately.

Kirsten's eyes opened. "Don't you even DARE bring Ryan into this, Julie. You know he loved that girl...I have to go. My husband is going on trial today. Think about it Julie. Take the time to think."

Julie opened her mouth to retort, but Kirsten hung up before she got the chance.

Sandy looked into the mirror as he straightened his tie. Kirsten walked into the room.

"She's taking it easier then I thought."

As Kirsten put back the phone she said, "I can't believe she thinks she doesn't deserve to be there. It's like she's not even SORRY for what she did. And you know as soon as they do a drug test, there's no chance of bail..." She rubbed her forehead.

Sandy approached his wife and kissed her. "Don't stress about this now honey. Not now."

Kirsten looked up and nodded. "You're right: first things first."

Kirsten knocked on the guest room where Seth and Ryan were getting ready. "You boys almost ready?"

"Just about," Seth yelled.

---

Kirsten knocked on Seth's room. "Kaitlin? You ready?"

"FOR...WHAT!?" She screamed and moaned.

"Well honey Sandy's going on trial," Kirsten scrunched her forehead.

"I'LL...BE...LATE..." She yelled again.

Kirsten nodded solemnly. "Luke too?"

"LUKE...TOO!" She screamed.

Kirsten nodded as Sandy rounded the corner. "What the hell is going on there?" He asked.

"Kaitlin and Luke are gonna be a little late."

Sandy and Kirsten in the front seat, with Ryan and Seth in the back, Sandy pulled out of the driveway.

"So is Jimmy meeting us there?" Kirsten asked.

Sandy nodded.

In a deep, announcer like voice Seth said, "The Trial Of Sandy Cohen."

"Seth!" Kirsten cut him off.

The Cohen Caravan sped down the road, and Seth spoke up. "I always kind of like....feel like when I'm not around, everyone cries out my name and wants me...but when I show up, everyone kind of goes about their business and never comments on anything witty I say!"

Kirsten turns around from her passenger seat and stares at her son.

The Cohen Caravan came to a complete stop in the parking lot of the courthouse. Seth hummed the tune of the movie "SWAT".

Sandy looked through the window at the large building. "I've came here over a hundred times...and not once have I been this nervous."

Kirsten put her hand on Sandy's shoulder. "It's going to be completely fine Sandy. Sometimes you've just--"

"Got to have a little faith?" Seth interjected. "Mom, come on. Don't steal lines from Prison Break when making speeches."

Kirsten shot Seth a look, and they all stepped out.

The Cohen Family walked down a long corridor when they ran into Summer. "Mr. C! I'm...just really sorry about everything," She said.

"It happens," Sandy nodded solemnly.

"Hey," Seth said to her, kissing her on the forehead.

"They have to talk to me before the trial...I'll see you before though, OK?" Sandy told his wife.

She nodded, and Sandy walked off. Ryan began to follow him and so did Seth.

"Sandy! Wait up!" Ryan yelled after him. Sandy stopped and turned around to see his two little men approach him.

"I just...want to tell you thank you," Ryan said.

"For what?"

"For...for everything...and the worst thing you've ever done, is decline your Man of The Year award," Ryan said with his head down.

Sandy let out a small laugh. "Hardly the worst thing I've ever done."

Seth looked at his dad. "I may have been a bit too...for lack of a better term, 'jokey' back there, but I didn't want it to come across as
bitch-like."

Sandy shrugged, smirking. "You're a Cohen."

"You're a Cohen," Seth added.

Both Seth and Sandy looked at Ryan. Finally, Ryan added, with a smile, the final piece of the puzzle. "We're Cohens."

Detective Rane sat in his home, in front of his computer as his phone rang.

"Rane," He answered.

"Sir, the hierarchy is requesting that Atwood kid back in two days."

"I gave him three."

"They said two."

"He's coming back in three," Rane answered decisively. He heard in the background, "You hear about that Cohen trial today!?"

Rane strained his ears to hear. "John, did he say the Cohen trial?"

"Yeah...why?"

Detective Rane had already hung up and was out the door.

Sandy approached Jimmy, who was looking rather fancy in a nice suit.

"Niice," Sandy smirked.

Jimmy shrugged modestly. "It's been a while since I've been to something that required a suit."

"Well either way...it means a lot that you're here, Jimmy."

"No, no," Jimmy shook his head. "I wouldn't miss it for the world. What you did...what you did was what any loving husband would've done. They have to see that."

"We can only hope," Sandy replied earnestly.

"Besides, I wanted to make sure their was a real judge."

Kirsten sat in a room waiting for her husband. Finally Sandy stepped out. "It's time," He said.

She stood and embraced her husband. "Sandy...whatever happens, you know that I love you, right?"

"I know baby, I know...I love you damn much," He whispered. Tears were coming down Kirsten's face as she gripped her husband.

"Oh Sandy..."

"Shh, shh..." He stroked her hair. "It's all gonna be OK..." He pulled back and looked at her. "Just have a little faith," He grinned.

She couldn't help but let out a small laugh through the tears. "Good luck," She embraced him again.

Finally, the two lovers pulled apart from each other. "I'll see you," He said.

Kirsten nodded as he was walked off.

Seth, Summer, Ryan, Jimmy, and Kirsten all sat in on a single row together as Sandy sat in a row in front of them.

Summer moved her hand and grabbed Seth's. They shared a quick glance, before their brief family peace was shattered.

The Judge slammed his hammer down. "The Trial of Sandy Cohen is officially underway. Mr. Cohen, please rise."

Sandy rose and approached the bench. The bailiff put the Bible down. "Do you swear to tell the truth and nothing but the truth?"

Sandy put his hand solemnly on the Bible as he looked into the eyes of his two sons, his wife, his son's girlfriend, and his best friend. Tears were forming in Kirsten's eyes, and all the men silently looked at Sandy. Boldly, Sandy replied, "Yes."

"Mr. Cohen, either your lawyer is extremely late, or he forgot about his client's trial," The judge commented a few minutes later.

"My lawyer is not either of those. He's here," Sandy replied smoothly.

"Where?"

"You're lookin' at him."

The Judge's eyes bulged. "You're representing yourself?"

Sandy nodded.

"Well then..." The Judge whispered to himself. He paused for a moment, then looked over the jury. Finally, he looked at Sandy's line of defense.

"Which one of you will testify for Mr. Cohen first?"

Summer's hand shot up quickly. "Me." She stood and swiftly sat in the necessary seat. All eyes in the room watched her take her oath and sit down.

"Plaintiff, please," The Judge said. The plaintiff rose and approached Summer.

"Let's start off with your age please."

"I'm 18."

"OK, so how exactly did you come to know Mr. Cohen?" The man asked.

"Well, I'd heard good things about him before I actually met him - and I met him when I began dating my boyfriend Seth, his son."

"And when you would be at the Cohen house, would you notice any...dangerous behavior exhibited by Mr. Cohen?"

Jimmy rolled his eyes at this remark.

"None," Summer retorted immediately. "In fact, you may have forgotten about this with all you do, y'know, taking people away from their families, but he was nominated for Man of The Year last year."

The man simply nodded. "I am aware of that."

"And also, while we're in fact, Sandy Cohen is my idol. He is a figure of complete and total control, and the ONLY reason he did what he did, is to defend his loving wife Kirsten...and I'm pretty sure there's nothing wrong with that."

"There isn't," The lawyer replied. "But you may not be aware that murder is illegal."

"Who's to say Carter wasn't going to murder Kirsten?"

"Ms. Roberts, this is a court of law. Argumentative behavior will have you thrown out immediately," The Judge interjected.

"Sorry," She replied quietly.

A pause before the Judge spoke again. "Is that all, ma' am?"

"Yes," Summer answered as she sat back down in her original seat.

"Thank you," Sandy mouthed. She smiled at him weakly.

"Good job," Seth told her.

The Judge spoke yet again. "Who will be next?"

Jimmy said nothing as he silently moved towards his destination. He completed his oath, and took his seat.

Kaitlin slowly put her jacket on over her tank top, her hair ruffled. "If we were to have sex one more time, I may need a wheelchair..." she whispered.

Luke slipped on his shirt, standing up. "I'm an optimist..."

She turned around and glared slyly at him. She approached him slowly. She leaned in close, trailing her hand down his chest. "I would love nothing more to stay here all day and never leave this room...but I need a break. Let's go to the trial, it's Mr. C after all."

Luke nodded, "I know."

"Alright, let's go," Kaitlin said. They both began walking out of the room.

As they walked out, Luke said, "Wait...Mr. C? I thought that was Summer's thing."

"In all my years of knowing Sandy," Jimmy said, "He's never had a revengeful bone in his body...I've...," At this, he gives an apologetic glance to both Kirsten and Sandy. "When I kissed his wife..." Kirsten gave a small smile through tears at this. "When we had those oh-so-awkward situations at our guy parties, anything and everything I or anyone did he forgave them...and I know him. And I know he wouldn't have done this unless he had to," Jimmy finished.

"You truly believe that?" the Judge asked.

"Absolutely."

"Is there anything else you want to add?"

Jimmy shook his head.

"You may go back to your seat," The Judge said.

Jimmy stood and walked back. Sandy nodded a thanks to Jimmy and patted him on the back as he passed. Jimmy took his seat next to Kirsten and she smirked, "I only remember one guy party..."

"I couldn't think of any other callbacks," He smirked.

Julie stood in line, in prison, for her lunch. She held her tray up to the cliched, mole-infested face lunch server. The lunch lady slopped something that was a cross between beans and Charlie Brown onto her tray.

She looks up from the tray, a feigned smile on her face. "Who said someone needs caviar to be considered upper-class?"

---

Sandy approached his bench of family members. He threw his arms open. "Anyone wanna say anything that makes me look good?" They all couldn't help but laugh softly.

Ryan raised his hand. "I'd...I'd like to say something."

"Only if it's good," Sandy pointed, a smirk on his face.

Ryan nodded, returning a small smile. He walked up slowly to the stand and sat.

He took a quick breath and then began. "I...I didn't grow up in Newport. I grew up in Chino, which, you probably know isn't the most upstanding part of California. My dad wasn't the most upstanding citizen of California either. I always...regretted being born into the family I was born into."

The eyes of all the Cohen's, Summer, and Jimmy wash over Ryan as he continues. "But then...everything changed. My brother and I got into some trouble, and long story short, Mr. Cohen took me in to live with him. He listened to whatever little I had to say at any given time, he acted like..." Ryan struggles to get the words out. "He acted like a real father...and he does everything for the Cohen family."

Sandy looks at Ryan as he speaks, a fatherly-shocked look on his face.

"I mean...back in Chino, the only nightmares I had ended up reality. I hope that kid doesn't beat me up tomorrow, I hope when I wake up my mom is here, I hope she isn't away for a week...but in Newport...the only nightmares I had were about returning to that...returning to Chino," Ryan finished. "I know that killing someone is extreme," Ryan can relate, it's obvious. Seth is the only one picking this up though. "But I recently had a family member die...and it felt terrible...and I'd never want Sandy to have to lose a great woman like Kirsten, and he shouldn't have to pay for being in love."

Ryan finally looked up from his gaze on the ground, and looks up to everyone.

"He talks!" Seth throws up his hands in celebration. Ryan can't help but smirk. Summer laughs as well.

Ryan finally leaves the stand. He stops in front Sandy. "Besides what I'm saying now," Sandy begins. "I'm speechless."

Ryan smirks.

"I love you, kid," Sandy embraces Ryan. They embrace, and Ryan finally breaks off the hug and sits back down.

"We're going to take a short recess, and we'll return in 10 minutes," The Judge said.

---

Everyone sat back down after their short recess in the court. The Judge spoke up. "Does Mr. Cohen have any last witnesses he'd like to call to the stand?"

Seth stands, and pulls out three sheets of paper from his suit jacket pocket. "I prepared a small speech," He mumbled.

"Oh God, Seth..." Summer whispers, embarrassed.

He walks up to the stand and sits. He reads from the paper. "Sandy Cohen is a good dad." He stands, bows, and moves back to sit down.

Sandy winks to his son. "Thanks son."

The Judge sighs. "I...I hate to take you away from your family, I really do...but these testimonies, while I have no doubt are all true, are from friends. From family members..."

Everyone lowers their head. They know what's coming.

Suddenly, the door opens. Detective Rane comes in, he was obviously running. "I'd...I'd like to testify for Sandy Cohen...I'm a detective."

The Judge debates it silently. "You have two minutes."

Rane nods, and approaches the bench. Ryan watches him in the shock -- they lock a gaze for a moment.

"I only recently learned about the Cohens," Rane began. "And I learned about them through a young man named Ryan Atwood...and I can't say how great a man Sandy is from experience, because I don't know him. But I do know his son Ryan. And I know that he has morales, and that he's one of the greatest damn kids I've ever had the pleasure of meeting."

Ryan and Rane lock another gaze. Ryan avoids his eyes after a moment.

"And to seperate this role model of a father from his kids, from his wife...it isn't fair. It isn't right."

The court room goes quiet. "Thank you, Detective," The Judge says.

---

Moments pass. The Judge is contemplating. Finally, he looks to Sandy, and to his family, and Detective Rane.

The entire court room watches intently. Scared and nervous faces are adored by everyone in the Cohen family, and Summer and Jimmy. Seth and Summer hold hands, as do Kirsten and Jimmy. Ryan watches alone, focused as could be.

"Sandy Cohen," The Judge begins. "The jury finds you--"
